The Allahabad High Court has refused to cancel the FIR registered against folk singer Neha Singh Rathore over her controversial social media posts. The decision came on September 19, 2025, when a division bench of Justices Syed Qamar Hasan Rizvi and Rajesh Singh Chauhan heard the case.
Allahabad HC Rejects Neha Singh Rathore’s Plea
The FIR was filed earlier this year at Hazratganj police station in Lucknow. Neha Singh Rathore was accused of promoting hatred between communities and threatening the unity of the country through her posts after the Pahalgam terror attack, in which 26 Hindu civilians were killed.
The High Court said that while Article 19 of the Constitution guarantees freedom of speech and expression, this right comes with reasonable restrictions to maintain public order, decency, and morality. After examining the police case diary, the judges noted that Ms. Rathore’s posts were derogatory towards Prime Minister Narendra Modi and also mentioned the Union Home Minister in a disrespectful way.

The court observed that her comments connected the tragedy with religion and politics, alleging that the BJP government was ready to sacrifice soldiers’ lives for political gain and pushing the country toward war. The judges said these remarks, made immediately after the terror attack, carried serious consequences because they were widely circulated, even in Pakistan.
The government counsel argued that Neha Singh Rathore’s posts showed anger against BJP leaders and deliberately created a Hindu-Muslim angle. They said that at a time when the nation’s security was under threat, such statements were irresponsible and could disturb communal harmony.

The High Court concluded that the allegations in the FIR revealed a cognisable offence and therefore required proper investigation. It refused to quash the FIR and directed Ms. Rathore to cooperate with the investigation. She has been asked to appear before the Investigating Officer on September 26, 2025.
