Copyright Strikes Fair Use Debate Sparks After Mohak Mangal Faces ANI’s YouTube Penalties

In recent times, a popular YouTuber named Mohak Mangal faced a big problem with copyright strikes from a news agency called ANI. Copyright strikes are warnings given to creators when they use someone else’s content without permission. If a creator gets three strikes on YouTube, their channel can be deleted. Mohak Mangal received two such strikes from ANI because he used short clips from their news videos in his own videos.

The clips were very short, around 9 to 11 seconds long, and were used in videos where Mohak was giving his opinions or analyzing news events. Despite this, ANI asked him to pay a large amount of money, nearly 45 to 50 lakh rupees, or risk losing his YouTube channel. This caused a lot of debate and anger among online users about copyright and fair use.

The main problem here comes from how YouTube’s Content ID system works. Content ID is an automatic system that checks every video uploaded to YouTube to see if it contains copyrighted material. When it finds something, it allows the rights owners to block, monetize, or take down videos. But this system does not always understand if the use of the content is fair, such as for commentary, criticism, or education.

Copyright laws were made long before the internet became so popular. These laws protect creators from their work being copied without permission. But the laws did not fully imagine how people today create new content by using and commenting on old content. So, sometimes copyright enforcement can be very strict and unfair to new creators who are adding value or meaning.

In India, the law allows for something called “fair dealing,” which means people can use small parts of copyrighted content for reasons like criticism or education without asking permission. But YouTube’s system doesn’t always recognize this. Because of this, creators like Mohak Mangal are sometimes forced to pay large sums to avoid losing their channels, even when they might be legally allowed to use the clips.

This case shows the challenge of balancing the rights of big companies who own content and the freedom of creators who want to share their views. It also highlights the need for clearer rules and better systems that protect both sides fairly.
